The state says that money and control were the two things that Swilley stood to lose as his marriage to Tim began to fall apart. Prosecution stated that the marriage between the two was declining, and Tim knew that it couldn’t be fixed. Swilley was also the beneficiary of Tim’s life insurance policy of more than $300,000.
