Just because somebody passes away in a nursing home doesn't mean their cause of action goes away. There is a possibility to set up an estate that would stand in the place of the injured person, and normally a family member or an attorney is set up as the executor of that estate and will bring a cause of action of whatever occurred against the nursing home.
