Q: I purchased a flat in Goa in 1998 and I plan to sell it. The sale agreement is ready. The promoter has power of attorney of the land. The land owner has expired and his children are abroad. How can I make a sale deed in this case?
Answer: As far as the sale of flat is concerned, once it is deceased, power of attorney granted is invalid. The power cannot be used hence a fresh power has to be made or the heirs have to be present at the time of the sale. Hire a lawyer to take a look at the agreement you signed it 1998 and find out that the conveyance has been provided or not as generally in a sale the promoter or the land owner is not required.
