Q: I bought a flat in Tata Amantra in Kalyan. My flat is ready for possession and I have paid all the dues. However, Tata Housing is insisting that they will hand over possession only once the sale agreement is registered and stamp duty is paid. I do not have immediate funds to register the property. I want clarity regarding the following:
Answer: Registration is mandatory under MOFA. Builder has to hand over possession as per the agreement between parties. In case of delay, builder has to refund amounts with 9% interest.The agreement is to be registered before the payment of more than 20% of the sale price of the flat. Registration is to be done within 8 months from the date of execution of the Agreement
