Q: I booked a flat in Jaypee Orchard, sector 128, Noida in 2011. The possession was supposed to be given in 2014 and latest by 2015. There are no signs of delivery. And the issue that we are facing is that we have to get the money back with interest. How do we deal with it? What are our legal rights?
Answer: This is a case of cheating and hence kindly file a criminal complaint either with the concerned police station and register a F.I.R. or file a private complaint under section 200 Cr. P. C. against the builder, for making false representation, assurance and guarantee and thereby inducing you to pay to the builder. Simultaneously file a suit for specific performance in the competent court and pray for injunction, restricting the builder creating the third party right.
