Q: I bought a flat in Bangalore in 2012. The builder completed the construction till 2016. But many amenities are not ready. He doesn't have an OC and the proper amenities are also not available. There's no power back up. I haven't taken the ownership of this property and have to pay 5% to register property. Shall I pay 5% and register the property or what else can I do?
Answer: It is in your interest that after paying 5% you register the property in your name at the earliest. There after issue a legal notice listing all the deficiencies in the amenities and facilities including the project not having been granted O.C. by the competent authority. There after file consumer complaint under the Consumer Protection Act, 1986 and pray not only for the registering of the property if not registered till then, as well as completing all amenities and facilities, obtaining O.C. as well as obtaining completion certificate and to compensate you on a daily basis till the aforesaid is complied with.
