Question: My Mom wants to sell her 3BHK residential flat at Santacruz (West). Currently my wife and I are staying in the same flat. It is a six storey building which has 24 flats, 4 on each floor. I would like to sell this flat to a Muslim buyer, but my Chairman is opposing it. The building I stay in is in a cosmopolitan area. The members are Sikh, South Indian, Jain, Bengali, Marwari, Christian, Maharashtrian and Parsi. I want to sell my flat to a Muslim since there is a big mosque outside my building on the main linking road extension. I am extremely worried since as no Hindu buyer is offering me market rate and last week one genuine Muslim buyer showed interest, but my Chairman said I cannot sell my flat to a Muslim. How do I tackle this situation?
Answer: You can go with the section 23 of the MCS Act 1960, no society can refuse admission without sufficient cause. If the society refuses to accept the application, the same can be forwarded via the registrar
