Question: I live in a society in Mumbai. Certain members of the society have not paid maintenance charges for many years. What is the remedy for this? Additionally, the society is charging members who give their flat on leave and licence an additional Rs 700 as donation for letting it out without staying in the flat. What can I do?
Answer: Society can give notice to such defaulter members who are not paying the maintenance and charge them penalty every month for delay or interest. Society can file a recovery suit u/s 101 of Maharashtra Co-operative Societies Act before Co-operative Registrar. There is no term of compulsory donation for letting out the flats. However, the society can impose additional charges for sub-letting the flat.
