To study the Andhra Pradesh's 'Disha Act' MVA govt had sent a delegation under the leadership of State Home Minister 'Anil Deshmukh' to AP immediately after coming to the power.
According to sources that the proposed act would be presented in the Assembly session scheduled in this month
What are the provisions of Shakti Act 2020?
1. Death Penalty for heinous Crimes.
2. 15 Days limit for investigations of the crime. Which may get another extension of 7days with valid reason.
3. Trial will be conducted on day to day basis and should be completed within 30days from filing the charge sheet and the case should be disposed of within 45 days with pronouncing the punishment instead of six months.
4. Taking a cue from the Andhra Pradesh' Disha Act, Maharashtra government has proposed the new act naming it "Special Courts and Machinery for the Implementation of Shakti Act 2020.
5. It has proposed to set up special courts at each district, special police teams, establishing institutes for providing various services to victims and having a women and children offenders registry
6. The acid attack has been made non-bailable offence with imprisonment not less than 10 years but which may extend to natural life with fine to be payable to the victim or with death with heinous offences. The fine would be levied up to Rs 10 lakh to help the victim for plastic surgery and facial reconstruction.
7. It also includes gang rape, rape by a person in authority, rape on the woman below 16 years and 12 years which attracts similar punishments.
8. Harassment of women by any mode of communication including social media would be liable to two years imprisonment with fine up to Rs one lakh. Even public servants who would fail to assist in the investigation would have to face imprisonment not less than six months but which may extend to two years or fine. He would have to face imprisonment of one month or fine of Rs five lakh for failure to share data by social media platforms and internet/mobile telephony service providers.
9. The act has proposed to add a section in IPC 354E for harassment, defamation, threat through social media platforms, telephone and other digital modes.
