The Supreme Court has quashed this order of the Madhya Pradesh High Court and has set aside the July 2020 order. The top court has quashed this order which allowed bail to sexual offenders. This after a Madhya Pradesh High Court granted bail to an accused after the victim tied him Rakhi, as per the directions of the court. The top court also stated that it is not only disrespectful to the victim but even traumatizing as well. In the wake of such an order, the Supreme Court has issued directions for sensitization of judges, further asking the judges to avoid the language that is trivializing the survivors.
The sad fact is that lack of gender sensitivity is malice in Indian society and it has unfortunately crept into the members of the Indian judiciary as well. I am glad it has now been seen at a macro level, though we still have a long way to go, says Aryama Sundaram.
