The state government's argument that the provisions of the Bombay Prohibition Act were upheld by the Bombay high court and later by the Supreme Court in 1951, and that any challenge to the validity of the current Gujarat Prohibition Act must be brought before the apex court, not the high court, was dismissed by the bench.
