The comments were made when the court was releasing a man accused of marital rape. The High Court, on the other hand, ruled that the accused be charged under Section 377 of the IPC for his unnatural bodily actions with his wife. The High Court stated that none of the elements formed an offense punishable under Sections 376 and 377 of the Indian Penal Code since marital rape is not recognized in India and is not a crime under Exception II of Section 375.
