20:16Now PlayingIn this episode of The Urban Debate, the host Shreya Dhoundial will be discussing how the Bombay High Court on Monday declared Chanda Kochhar, the former CEO and MD of ICICI Bank, and her husband Deepak Kochhar's detention by the Central Bureau of Investigation (CBI) on December 23, 2022, in violation of the law and ordered their release on Rs 1 lakh guarantee each. Due to the lengthy process of procuring surety, their counsel requested release on cash bail, which the HC approved. The high court declared that there had been a violation of section 41(A), which justified their release. It said, "The arrest has not been in accordance with the provisions of law." The duo claimed in their appeals that the CBI's arrest of them was illegal and arbitrary. A few panelists join us. “"The courts have shown very clearly that they value personal liberty as a very important fundamental right and they will enforce it more strictly," says Aryama Sundaram, Senior Advocate. "The CBI manual instructs that a person won't be arrested if they are cooperating & there's no chance of them tampering evidence. That guideline wasn't followed," says N R Wasan, Former DG, NIA.
