An existing law that prohibits unmarried women between the ages of 35 and 45 from using surrogacy services has been challenged in a Supreme Court petition. Now, the Supreme Court has written to the Centre to request their opinion on the situation. The Centre has not yet responded to the Supreme Court's notice. Laws governing surrogacy were changed a while back to prevent the practice from becoming a business. In fact, this is a very significant issue raised by the petitioner in this case. Two moths back, the Supreme Court had very significantly given abortion rights to unmarried women and also said that "such a woman can abort till 26 weeks." Following the historic ruling by Chief Justice of India DY Chandrachud, an unmarried woman also petitioned the court on the surrogacy issue.
