The Trump administration just swore in 42 new immigration judges, and not a single one comes from the private immigration bar. That means not one has ever represented an immigrant. ⚖️ A recent article in Reuters explains that the Justice Department hired these judges as part of a deliberate effort to reshape immigration courts by filling them with what the administration openly calls deportation judges instead of immigration judges. More than a third previously worked at the Department of Homeland Security, with several coming directly from ICE as government lawyers. Others have backgrounds as prosecutors or in military service, and one is a former Republican state lawmaker who publicly opposed funding lawyers for immigrants facing deportation. In past administrations, new classes of immigration judges usually included attorneys from the private immigration bar. Lawyers who spent years representing asylum seekers and families in removal proceedings and who understood the system from the perspective of the person across the courtroom. That is gone now. Since January 2025, the Trump administration has fired more than 100 immigration judges and pushed out nearly as many through buyouts and forced resignations, replacing them with appointees whose entire careers have been on the enforcement side. 📄 These judges will be deciding asylum cases, and the administration is not pretending to be neutral about the outcomes it expects. Attorney General Pam Bondi said the new judges will decide cases based on the law, not politics. But when every single hire comes from prosecution and law enforcement, that tells you a lot about the results they expect. A hostile judge does not automatically mean losing a case.
