Once again, we see unelected, black-robed, tyrannical, inferior federal district trial court judges acting lawlessly to hamstring the ability of our democratically elected Article II Executive Branch President Trump to defend our nation’s sovereignty against foreign invasion, ruling instead in favor of the illegal migrants engaged in that invasion.
On the bright side, however, we also see other MAGA federal judges fighting against these feckless rulings and handing the Supreme Court a roadmap to arriving at the constitutionally correct decision to defend America from foreign invasion.
We have a great example of a federal judge fighting the good fight in the dissent of Trump-appointed Judge Barbara Lagoa in recent 2-1 11th Circuit decision against Trump’s authority to detain long-term invaders of America. (Incidentally, Lagoa was considered by many to have been the second-choice just behind Amy Coney Barett for that SCOTUS seat.)
While Lagoa’s lengthy dissent comprehensively tears apart the majority’s feckless decision, of particular interest is the portion that focuses on the “major questions doctrine,” the very doctrine that SCOTUS recently used to deny Trump tariff authority. Distinguishing that tariff situation from this mandatory detention situation provides SCOTUS with the roadmap for how they should support Trump here even where they failed to do so with respect to Tariffs.
There now exists a real split among the federal district courts of appeal whether Trump has the legal authority to mandate the detention of illegal invaders who have been living unlawfully in our nation for years, in the same manner he has for detaining illegals who have recently violated our national sovereignty.
The recent 2-1 decision of the 11th Circuit Court of Appeals, with Lagoa in dissent, engages in the usual Progressive legal word salad and disingenuous misrepresentation of the law to rule that Trump lacks the authority to order the mandatory detention of long-term illegal migrants—a ruling made by a three judge Obama-Clinton-Trump (dissent) panel . In this they join the 2nd Circuit Court of Appeals in a ruling made by a three-judge Biden-Clinton-Trump panel. (although unanimous decision).
On the opposite side of the circuit split are the Fifth Circuit 2-1 decision (Reagen-Trump-Biden (dissent) and the Eighth Circuit 2-1 decision (Bush-Trump-Bush (dissent).
That split means this is all certain to end up in the lap of SCOTUS.
Note that once again we see judges on the “right” willing to cross political lines to join with Progressives in ruling against Trump, but the Progressive judges invariably vote in lockstep with their political machinations against America’s sovereignty.
For today’s show, let’s take a close look at Judge Lagoa’s dissent, in particular the portion focusing on the “major questions doctrine.”
