During the early morning hours of February 5, 2023, Officer Richards of the Ocean Township Police Department noticed a 2011 Nissan swerving and driving in an erratic manner. After he initiated a vehicle stop, he asked the driver where she was coming from and where she was headed. The driver, later identified as 28-year-old Marina Gjorgjijoska, told the officer that she was coming from Asbury Park and that she was headed home to Ocean Township, New Jersey. Officer Richards detected an odor of an alcoholic beverage emanating from the vehicle, and Gjorgjijoska’s eyes appeared watery and bloodshot. Gjorgjijoska eventually admitted to drinking alcohol earlier that night.

Based on his suspicion of intoxication, Officer Richards afforded Gjorgjijoska the opportunity to perform standardized field sobriety tests (SFSTs). The first test was the Horizontal Gaze Nystagmus (HGN). The HGN test showed that Gjorgjijoska had a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and had an onset of nystagmus prior to 45 degrees of deviation in both eyes. During the Walk and Turn test, Gjorgjijoska lifted her arms from her sides, was not heel-to-toe on most steps, stepped off the line several times, and later stated that she forget the rest of the test. On the final One Leg Stand test, Gjorgjijoska counted incorrectly and could not maintain her balance.

Due to Officer Richards’ observations of Gjorgjijoska’s vehicle operation, her admission to having consumed alcohol, and her failure to adequately perform the field sobriety tests, Gjorgjijoska was placed under arrest for driving under the influence. Gjorgjijoska was transported to OTPD headquarters for further processing.

Once at police HQ, Gjorgjijoska agreed to take a breathalyzer test. Her Alcotest results indicated a BAC of 0.156%, nearly double the legal limit. Officer Richards noted that during the booking process, Marina went from crying hysterically to laughing uncontrollably in a split second. Once the booking process was complete, she was issued the following citations: Driving under the influence, reckless driving, careless driving, failure to maintain lane, and delaying traffic.

Based on what Gjorgjijoska had told the officers earlier (withheld for privacy), it was determined that Gjorgjijoska should be taken to the hospital after the booking process was completed. Officer Richards transported Gjorgjijoska to Monmouth Medical Center for further evaluation in the emergency room. Hospital employees were instructed to not release Gjorgjijoska until she was sober.
