British Girl Punches Cop During SECOND DUI Arrest in Less Than a Year

Around 1:30 AM on February 20, 2022, Officer Joshua Baar with the Tampa Police Department observed the driver of a white 2016 Mercedes speeding 68 MPH in a 40 MPH on Armenia Avenue zone and later through 3 red lights. He began pursuing the vehicle, and eventually initiated a traffic stop on Howard Avenue. He exited the vehicle and made contact with the driver of the Kia, who was identified as 22-year-old Emily Smith.

As he was speaking with Emily, he observed indicators of impairment and asked her how much she had to drink. Emily initially denied having anything to drink, but Officer Baar then asked her where the wristbands were from. She told him that she had been at a nightclub called Eden earlier that evening, and she would later admit to having 2 drinks before driving. Based on his suspicion of impairment, Emily was transported to a nearby parking lot so that he could administer field sobriety exercises.

Officer Baar started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Emily did not touch heel-to-toe in each step and failed to count aloud as instructed. The final exercise was the One Leg Stand test. During the One Leg Stand test, Emily failed to raise her foot in the proper fashion.

Based on her erratic driving, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, Officer Baar told Emily that she was being placed under arrest for DUI. As he was placing the handcuffs on her, Emily immediately began to resist and punched him in the back of the head several times. Another officer immediately intervened and there was a brief struggle before she was placed inside the patrol car.

Emily was transported to the Hillsborough County Sheriff’s Office for further processing. At the jail, she refused to submit breath samples. She was charged with a DUI (316.193(1)(A)), resisting officer with violence (843.01), and driving with a suspended license (322.34(2)(A)). Emily was eventually released pending her court appearance.

Emily had previously been arrested by the Tampa Police Department for DUI on September 29, 2021. Following her previous DUI arrest, she did submit breath samples that time and her BAC level was 0.096%.
