House managers and President Donald Trump’s defense team argued over whether “abuse of power” is an impeachable offense based on the language the farmers put in the Constitution. Trump attorney Alan Dershowitz said that even if impeachable offenses do not have to be crimes, abuse of power is too vague to be impeachable. He argued that the framers specifically did not include a similar term — maladministration — in the impeachment clause. Rep. Jerry Nadler, D-N.Y., countered that every presidential impeachment has included abuse of power and scholars generally agree that abusing the presidential office is impeachable. The debate came in response to a question from senators who had their first chance to ask questions of the House managers and Trump’s legal team on Wednesday, Jan. 29. The House of Representatives impeached Trump in December on two articles — abuse of power and obstruction of Congress. The questions come ahead of a vote on whether to bring forward witnesses and documents as part of the Senate trial. The senate must now decide whether to acquit the president or convict him of the charges and remove him from office.
