Marine Daniel Penny, now 26, is currently on trial in Manhattan Criminal Court in the 5/1/23 death of Jordan Neely, a 30 year old homeless mentally ill man with more than 40 prior arrests, with synthetic cannabinoids in his system, who lunged into an uptown F subway train with balled fists, demanding food & money, shouting that he was willing to die & ready to serve a life sentence. As petrified passengers hid behind baby strollers and flooded to one end of the subway car, when Neely threatened to kill, Penny jumped into action and with the assistance of other passengers, placed Neely in a sleeper hold to subdue him until the train could reach the next stop for police to arrive. Despite the fact that first responders found a pulse, administered Narcan, and Neely was breathing when they arrived, after Neely died, Penny was charged with manslaughter & negligent homicide and faces up to 15 years in prison. Penny has pled not guilty and claims self defense of himself and others. It will be up to a jury to decide his fate.
