The AR ban.
The feature restrictions.
The ten-round magazine limit.
All of it got wiped off the board.
But the most important part of this ruling is who wrote it.
Judge Arianna Freeman — a Biden appointee, former public defender, and the first Black woman to sit on the Third Circuit — just handed down one of the biggest Second Amendment wins in years.
That matters because the gun-control lobby cannot easily dismiss this as some partisan ruling from a judge they expected to be on the other side.
She looked at New Jersey’s ban, measured it against the Constitution, and said no.
The court ruled that bans on broad classes of semi-automatic rifles and magazine limits violate the Second Amendment when those arms are in common use for lawful purposes.
That phrase matters:
Common use.
The AR-15 is one of the most commonly owned rifles in America. Millions of law-abiding people own them, train with them, defend their homes with them, and never hurt anyone.
You cannot call the most popular rifle in America “dangerous and unusual” just because politicians don’t like how it looks.
And the court made another point that matters even more:
Good intentions do not save an unconstitutional law.
You can say your goal is reducing gun violence. Everybody wants less violence. But that does not give the government the power to erase a constitutional right.
This ruling is bigger than New Jersey.
The Supreme Court is already preparing to review assault weapons bans out of other states, and now there is a federal appeals court ruling saying these bans violate the Second Amendment.
That kind of split is exactly the pressure that can force the Supreme Court to settle the issue for the whole country.
New Jersey is not going to give up quietly.
But today, the Second Amendment won in a state that spent decades trying to legislate it into a technicality.
