Suppressor Registration Just Got Gutted In Federal Court

A federal judge just tore a hole in the National Firearms Act without mentioning the Second Amendment one time.

The whole thing came down to a tax.

When Congress passed the NFA in 1934, they didn’t sell it as straight gun control. They sold it as a tax scheme.

Suppressors, SBRs, and short-barreled shotguns were taxed.

And to prove you paid the tax, you had to register the item with the government.

The registration was the receipt.

That was the trick.

But once the tax was cut to zero dollars, the obvious question became:

What exactly is the registration collecting?

That is where this ruling gets interesting.

For ninety years, the government defended NFA registration by tying it to Congress’s taxing power.

Then the tax disappeared, and suddenly the government tried to argue the same paperwork could be justified another way.

The judge didn’t buy it.

And honestly, the way the gun groups set this up was borderline masterful.

They beat the NFA at its own game.

Now, don’t get stupid.

This ruling is not nationwide for everybody yet. It has a short stay so DOJ can appeal, and it does not apply to machine guns.

So if your suppressor or SBR is sitting in eForms right now, talk to your dealer and watch what happens next.

But the bigger point is impossible to ignore:

They were never attached to the money.

They were attached to the list.

For decades, gun owners said the paperwork was not really about tax collection.

They got called paranoid.

Then the tax hit zero, and the government fought to keep every bit of the paperwork anyway.

That tells you everything.

The strategic plan is working.

And the NFA’s tax argument just came back to bite them.
