Question: I have a development agreement to redevelop my property in Thane. The property is registered in my mother's name. The builder has given the allotment letter in my father's name. My mother passed away and my father is the owner now. Should I get my allotment letter registered along with my registered agreement? Owners are mutated with concerned authority. Is allotment agreement needed in this case, if yes- should it be registered? Stamp duty has been paid.
Answer: The registered development agreement itself should contain a provision for allotment and therefore the allotment stands stamped and registered. If a separate authority letter us made, it is advisable to have the same duly stamped and registered.
