Question: A redevelopment agreement was made for my society. The developer wanted to give the project to his sister company. The first developer was given a 79a Certificate. The members did not nullify it. The second developer was not given this certificate because the meeting was illegal. The deputy registrar refused to give a certificate and cancelled the first developer's agreement. The registrar did not recognise the second developer and thus did not provide him the 79a certificate. How do we move this forward? It's been 2 years since the redevelopment is hanging in limbo.
Answer: First terminate the earlier development agreement which was executed with the first developer. Start the entire process all over again. If the development agreement is already registered then file a suit in High Court for cancelling the contract.
