as posted by the channelThe Supreme Court on Monday referred a Suo moto petition to a five-judge Constitution bench for instructions on how and when relevant mitigating factors should be examined by courts during trial in cases involving the death penalty as the highest punishment. A bench led by Chief Justice UU Lalit stated that this case required a hearing by a constitutional bench in order to have clarity and a consistent approach as to when an accused facing the death penalty as the maximum sentence must be heard with regard to mitigating factors. The Supreme Court had taken note of the matter, stating that there was an urgent need to guarantee that mitigating factors for convictions of crimes carrying the prospect of death were considered.
