The court stated that there is no way that the state can restrict interfaith couples from marrying. This observation came out when foreign nationals, an interreligious couple, moved to the high court saying that they had been living in Delhi for the last six months and wanted to continue their stay in India and also wished to marry under the Special Marriage act. An American man and a Canadian woman who is Hindu wanted to get married in India. The court made a crucial observation that there is now a way the state could prohibit their marriage under the particular marriage act.
