It remains to be seen if and when proposed changes to the work permit framework for asylum seekers will go into effect. But let me be clear — if it happens, it will be devastating 🚨 It will make it basically impossible to get a work permit. That goes for both first-time applicants and for people seeking to renew. Litigation might block this attempt entirely. If it does go into effect, it will most likely be several months from now ⏳ We are in a 60-day comment period that ends on April 24, 2026. After that, DHS is supposed to take into account and respond to the public’s comments on the proposed changes. Normally, that process takes several months. Then they’re supposed to propose a final version of the rule, and there are administrative procedures that take a while. After that, the changes aren’t supposed to come into effect until 60 days after most final rules are published. But DHS could try to argue that this case falls within an exception where only 30 days need to pass before the final rule takes effect. And of course, DHS could just try to disregard all the rules and ram this into effect on April 25. It’s impossible to predict with much certainty when this will go into effect, but I would say probably several months from now 📌
