However, neither the prosecutor, judge, or the guy's own defense lawyer decided to take this valuable step. Rather, they just decided to guess what the drug was, what it does, how dangerous it is, and what sentencing multiplier should be given.
Everyone looks around, says "this is fine".
The defendant disagreed however. On his own (pro se), he protests to the court of appeals, taking the bold position that a court should probably understand what it is talking about BEFORE sentencing someone to prison, just a thought ...
