The lawyer arguing for the gun owner was the ACLU.
This case involved a Texas man challenging a federal law that barred drug users from owning guns. The government didn’t have to prove he was dangerous. They didn’t have to show he harmed anyone. They just put him in a category, labeled him a “user,” and tried to switch off his Second Amendment rights.
The Supreme Court said no.
All nine justices agreed.
But this ruling is not as broad as some people think. The Court did not strike down the entire law. The statute is still on the books. This was a narrower decision about how the law was applied to this specific person.
And that’s the bigger lesson.
The government loves categories.
Drug user.
Felon.
Prohibited person.
Dangerous.
Whatever label they can attach to you becomes the excuse to take the right without proving the person is actually a threat.
This decision says if the government wants to take someone’s Second Amendment rights, it has to do more than point at a label.
It has to show its work.
And the fact that gun-control groups fought to keep this ban alive while the ACLU and NRA landed on the same side tells you exactly what this fight is really about.
Take the win.
But don’t get comfortable.
Because this was one case, one label, and one fight.
