Question: I booked a flat in Lodha Casa Rio at Palava city, Dombivali. I received the possession letter a few days back. I will get possession in a month. The OC is not ready and the developer says it will take 6 to 8 months. They've asked me to take possession. Should I take possession without OC? Will it take 6 to 8 months for a developer to get the OC?
Answer: It is not lawful to take possession of a buyer without OC, under MMC Act. In case fit outs are to be carried out, you may take possession for fit out purpose. If all conditions for obtaining OC such as completion of construction, essential supplies etc. are complete, then the same shall be obtained within 6-8 months. Do not accept possession of your home if the OC is not granted for that particular building.
