Answer: However, it is likely that this judgement will be challenged by the department before the Apex Court. Since service tax is an indirect tax levy, the builder may recover the service tax from buyers till finality of said judgement or seek indemnity for the same. You can go to the developer and have a conversation; you can also point out about the judgement and pay the service tax under protest.
