Answer: In case there is no registered agreement for sale, your father can transfer the flat to you before possession pursuant to obtaining the written consent of the builder. On obtaining the consent of the builder, a fresh allotment letter can be issued in your name. In case there is a registered agreement for sale and the property has already been conveyed to your father, it is advisable to transfer the property by making the builder a confirming party to your transfer agreement. Please note the builder may levy transfer charges depending on clauses in your agreement or MOU.
