Question: I bought a property in Greater Noida from Ansal in a 2,500 acre project. The project has been delayed since last 5 years. While making the agreement the company didn't add the clause of compensation. I was told that the possession would be given on time. The construction of the project is moving slowly. What is the recourse available for me?
Answer: You can either approach the Consumer Forum or in light of the new Real Estate Act wait for the Authority to be established and take action under the provisions of the new Act. Under section 4(2) (b) of the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010 every promoter shall specify in writing the date by which construction of the apartment is to be completed and declare the penalty for delay in completion of the building. Therefore, the builder is under a statutory obligation to compensate you in case of delay.
