Question: My father has a property in Mumbai which is undergoing redevelopment. We were tenants in this property for 30 years. My father is 76 years old and we now want to get the property registered in my sister's name. What is the procedure to register the property in her name? Can we register it through a gift deed, GPA (general power of attorney) or a consent letter? Should we register the gift deed? Can I carry out the transfer process in Bangalore for a property in Mumbai?
Answer: Please note that tenanted property cannot be gifted and we have to execute a deed for transfer of tenancy. The transfer process will have to be carried out in Mumbai.
