The historic judgment by the constitutional bench of the Supreme Court today upheld the union government's decision to give a 10 percent reservation to the economically weaker section of society. 5Judge lead bench passed the decision with a 3-2 majority. A plea was filed in the Supreme court challenging the government's decision that this reservation would violate the fundamental structure of the constitution and would cross the limit of 50 percent reservation. It was the first time reservation was given on economic grounds rather than social. Citizens belonging to the general community having less than 5-acre land and having a house under 100 square feet are eligible to get 10 percent reservation in any government job and facilities.
The supreme court rejected the plea by saying that it did not violate the fundamental structure and that everyone has the right to social and economic justice. Tehseen Poonawalla, a Petitioner in the case, asked 'how many of the sitting supreme court and high court judges are from SC and ST community?
