As such, illegal Rohingya Muslim migrants do not have a fundamental right to reside and settle in India. It said that anyone who enter India illegally would face legal consequences and be subject to the Foreigners Act's requirements. The Ministry of Home Affairs of the Union government stated, "India would handle the issue of Rohingyas based on its own domestic framework, since it is not a signatory to the 1951 Refugee Convention and its Protocol relating to the Status of Refugees."
