The analysis has two parts. ⚖️ First, were you physically present in a third country after leaving your home country? Even a layover or a short stop where your plane landed can count as physical presence. Second, did you have permanent residency or an offer to obtain it in that country? 📉 Some immigration judges interpret this very broadly, including certain renewable temporary statuses or even marriage-based eligibility for residency. If both elements apply, you could be barred from asylum unless an exception saves your case. 💔 One major exception is if you also faced persecution in that third country.
