Around 1:30 AM on December 3, 2023, Officer Noah Kvamme with the Athens-Clarke County Police observed a 2018 Ford Fiesta and another vehicle run through a stop sign in the vicinity of W Broad Street and Old Epps Bridge Road. The vehicle later ran a red light at another intersection as the driver continued to follow the other vehicle in front. The officer initially thought it may be a road rage incident, but he later learned that the driver was following the vehicle in front. The driver, later identified as 26-year-old Anna, pulled into a parking lot and Officer Kvamme made contact with her.

Officer Kvamme told Anna that he observed multiple traffic violations. As he was speaking with her, he detected the odor of alcohol. Anna admitted to consuming 3 drinks earlier that evening. Based on his suspicion of impairment, Officer Kvamme asked Anna to exit the vehicle and perform field sobriety exercises in the parking lot.

Officer Kvamme started with the Horizontal Gaze Nystagmus (HGN) test, and he observed the lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation. He also observed a lack of convergence. The second exercise was the Walk and Turn test. During the Walk and Turn test, Anna did not touch heel-to-toe on each step and turned improperly. The third exercise was the One Leg Stand test, and Anna failed to raise her foot in the proper fashion while using her arms for balance. Officer Kvamme repeated the HGN test once again before determining that she was not safe to drive.

Anna was offered the opportunity to submit to a portable breath test, but she refused. Officer Kvamme asked her whether she had been arrested for DUI before, and Anna admitted that she had previously gotten a DUI when she was 21. Based on her erratic driving, the odor of alcohol, her admission to consuming alcohol, and her inability to adequately perform the field sobriety exercises, Anna was placed under arrest for DUI.

After Anna was placed under arrest, Officer Kvamme read her the Georgia Implied Consent Notice, but she refused to submit samples of her blood or breath. After a female officer arrived on scene to search Anna and her friend came to retrieve her vehicle, Officer Kvamme transported Anna to the Clarke County Jail for further processing. Anna was issued the following summonses: DUI – Alcohol – Less Safe (40-6-391(a)(1)) and Obedience to Traffic-Control Device Required (40-6-20)
