Entitled Woman Flees Car Crash at Over DOUBLE the Legal Limit

Around 1:13 AM on April 22, 2023, Officers Williams and Allen with the Fruitland Park Police Department responded to a motor vehicle accident involving a vehicle that had left the roadway and struck a sign in the vicinity of U.S. Highway 27/441 and Miller Street. As Officer Allen arrived on scene, she observed a black 2016 Toyota Avalon appearing to flee. She remained at the scene to get statements from the witnesses while Officer Williams pursued her and initiated a traffic stop on N Dixie Avenue north of the intersection with W Miller Street. The woman behind the wheel of the car was identified as Emily.

As Officer Williams was speaking with her, he detected the odor of alcohol and observed other indicators of impairment. Emily denied having been in an accident despite the apparent damages to her vehicle. Since Officer Williams believed that Emily was not able to safely operate a motor vehicle, he initiated a DUI investigation. Emily was asked to exit the vehicle and perform field sobriety exercises. Sergeant Flannary escorted her to the parking lot of the nearby Circle K as Officer Williams moved his car.

She eventually agreed to perform field sobriety exercises and Officer Williams started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Emily did not touch heel-to-toe on each step, turned improperly, and took an incorrect number of steps. The third exercise was the One Leg Stand test, and Emily failed to raise her foot in the proper fashion and put her foot down before the test was complete. The final exercise was the finger-to-nose test.

Based on her the motor vehicle, the odor of alcohol, and her inability to adequately perform the field sobriety exercises, Emily was placed under arrest for driving under the influence. After Emily was placed in the car, she was transported by Officer Williams to the Lake County Jail. Her vehicle was impounded by Kings Towing around 2:45 AM.

At the jail, Emily agreed to submit breath samples for testing. Her breathalyzer results indicated BAC levels of 0.213% and 0.201%, which were more than double the legal limit of 0.08%. Officer Allen cited Emily for DUI – property damage (316.193(3)(c)1), leaving the scene of a crash without giving information (316.061(1)), and careless driving (316.1925). After the breath test was administered, Officer Williams turned Emily over to booking staff.
