Around 12:05 AM on July 15, 2023, Patrolmen Antonio Flores, Kevin Connor, and Michael Richards with the Highlands Police Department were called to a report of a disorderly female at Driftwood Liquors located at 300 Bay Avenue. They arrived on scene and made contact with the female who had been escorted outside the bar, and she was identified as Leah. She claimed that her boyfriend had driven away and she admitted to getting into an altercation with the bartender after she refused to serve her any more drinks.

Patrolman Connor walked inside to get a witness statement from the bartender while the other officers spoke to her outside. As Patrolman Connor returned to speak with the other officers outside, Leah was informed by Patrolman Flores that she was being placed under arrest. Patrolman Flores escorted Leah to the patrol car and transported her to the Highlands Police Department for further processing.

After Leah was processed, she was released with a summons pending her appearance in the Highlands Municipal Court on July 18, 2023. Patrolman Connor provided her with a courtesy transport back to the Extended Stay America in Red Bank where she was staying. Leah was charged with simple assault (2C:12-1A(1)) and disorderly conduct (2C:33-2A(1))

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
