Drunk Girl Crashes After Going Snowboarding

Around 8:55 PM on January 12, 2026, Patrolman Joseph Savittieri with the Kinnelon Police Department was dispatched to Route 23 South in the vicinity of Northgate Road on a report of a single vehicle motor vehicle accident. He arrived on scene and noticed that a silver 2010 Honda Accord had crashed into a curbed median. He then made contact with the driver, who was later identified as 24-year-old Nicole Guzman.

Nicole said that she crashed while trying to navigate a sharp turn. When he asked her where she was coming from, she told Patrolman Savittieri that she had gone snowboarding at Mountain Creek Resort in Vernon Township, New Jersey. As he was speaking with her, he detected the odor of alcohol as well as the order of burnt cannabis. Nicole admitted to consuming alcohol earlier that afternoon, but also claimed that she had smoked cannabis the previous day. Based on his suspicion of impairment, Nicole was asked to perform field sobriety exercises after additional officers arrived on scene to assist.

The first exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Patrolman Savittieri observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test. During the Walk and Turn test, Nicole failed to touch heel-to-toe on each step, turned improperly, and took an incorrect number of steps. The final exercise was the One Leg Stand test. During the One Leg Stand test, Nicole failed to raise her foot in the proper fashion and put her foot down before the test was complete.

Based on the motor vehicle crash, her indicators of impairment, the odor of alcohol, her admission to consuming alcohol earlier that day, and her inability to satisfactorily complete the field sobriety exercises, Nicole was placed under arrest for DWI. A search of her vehicle incident to arrest yielded the presence of an open container and a cannabis cigarette. Her vehicle was impounded for a 12-hour hold according to John’s Law.

Patrolman Savittieri transported Nicole to the Kinnelon Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, and she agreed to submit breath samples. then transported Nicole to the nearby Florham Park Police Department for the administration of the breath test. Her Alcotest results indicated a BAC level of 0.11%, which was above the legal limit of 0.08%. After they finished processing her, Nicole was released to Luciano Silva pending her court appearance after he signed the Potential Liability Warning form on Nicole’s behalf.

Patrolman Savittieri issued Nicole the following citations:

-Operating under the influence (39:5-50)

-Reckless driving (39:4-96)

-Careless driving (39:4-97)

-Traffic on marked lanes (39:4-88)

-Open container (39:4-51B)

On June 9, 2026, Nicole’s citation of operating under the influence was dismissed. Instead, she pleaded guilty to reckless driving and open container. As a result of her convictions, Nicole had to pay a total of $480 in fines and use an ignition interlock device for 90 days. The other 2 citations were also dismissed as part of a plea agreement.
