The rationale for this is that equal pay should mean equal work, and basis a current salary on prior salary history is in opposition to this goal.
In today's legal analysis, we discuss the free speech implications of this regulation out of Philadelphia, and whether forbidding asking about prior salary information violates the first amendment, or whether it it valid under intermediate scrutiny which typically applies to commercial speech such as advertisements.
