Question: My society permitted a family of 10 adults to occupy an 850 sq ft apartment. Is there any limitation on the numbers of the tenants who can reside in an apartment?
Answer: Under the bye-law of Co-operative societies 2014 (Maharashtra) bye-law 75(A) gives a right to a member to occupy a flat in the co-operative society. If a member wish to sublet his flat then he has to follow the bye-law 43 and inform the society accordingly. There is no such restriction of a number of persons to occupy one flat but in the case due to overcrowding, there is nuisance created in the society then its members has every right to contact to local police as well as approach the Co-operative Court under the said Act or relief against society as well as tenants.
