Question: My society is undergoing redevelopment. Many illegal activities are occurring here. The builder met the committee and without our consent, installed a tin sheet even while we are staying here. We have protested at the BMC. However, we are getting no legal recourse. Can the builder install tin sheets at this time? The builder has no IOD/CC, no documentation. What can we do?
Answer: Since the society has not entered in to any development agreement with the so called builder the activity installing a tin sheet is absolutely illegal and thus members can approach the Co-operative Court establish under the MCS Act, 1960 and u/s 91 of the said Act, file a case against the committee members and the so called builder restricting them from construction as well as encroaching upon the society's premises.
