Be Un Confused

Expert: Hemang Jariwala, Advocate at the Bombay High Court.

Question: I’ve bought a property in Thane in 2009. Second-hand. Parking lot was in the contract. Parking agreement was there along with sale agreement. After I bought the property and was out of country. Society formed an office on my parking space. The society told me that in the agreement that it first was not clear. Giving excuses. Parking is allotted to me as per the agreement that I have.

Answer:  First shoot a legal notice to the society stating that they have taken your open car parking space and have also constructed an illegal a society’s office,  so kindly demolish it and handover your parking space. If they don’t then take this matter to the Thane Municipal Corporation ,pursue the matter with the ward officer or assistant commissioner.  If also the corporation don’t take any steps, then you can file a Rate of Mandamus to the High Court to give direction to the corporation.
