Question: In 2011 our developer was selected as per 79(a). He wanted to change the developer who did sign the development agreement quoting that it is a sister concern. The agreement was signed by LLP and Mumbai District Co-operative Housing Federation confirmed that change of developer is possible. But after signing the development agreement deputy registrar refused to give NOC to the new developer. Without any fault of the members, the project has been stalled. What can we do?
Answer: The entire 79(a) was done to safeguard the interest of the society members. You can file an appeal before the Appellate Registrar Court.
