Question: I purchased a flat in Supertech Ecovillage 1 in Noida Extension in 2011. The possession demand has been issued now in which the builder has asked for an additional Rs 9 lakh than the original cost mentioned in the allotment letter citing increase in super area and building material escalation charges. I want to know my options?
Answer: The buyer should not pay any extra amount if it is not part of the original agreement. Under these circumstances, the buyer can cancel the project and book something else because now the prices have fallen. He can say that he is not interested as the builder has unilaterally and arbitrarily has changed the terms of the agreement. He can alternatively issue a legal notice to the developer.
