Question: We had booked a 2-BHK in Panvel. However, due to some legal issue the builder was not able to complete the project. We buyers took a collective decision to cancel our bookings but the developer is not returning the money. What shall we do?
Answer: You can file a criminal case against the builder along with a complaint in consumer court because there has been a violation of Section 4 of MOFA (Maharashtra Ownership Flat Act). The case will come under MOFA because the agreement is done under it.
