On 8th October, Dindigul Fast Track Court acquitted a 19-year man who was charged with rape and murder of a minor girl.
The accused was booked under sections 449 (House trespass in order to commit a crime) and 302 (Punishment for murder) of IPC and Section 5 (m) r/w 6 of POCSO Act (Aggravated penetrative sexual assault).
But the accused was acquitted as two crucial points of the case was not accurately proved with evidence by the prosecution.
The Police investigation report had stated that the accused had inserted wires into the victim's mouth and nose and electrocuted her to death. This point was also recorded as a confession statement.
But the medical team who conducted the autopsy had suggested that 'the deceased would have died of asphyxia due to compression of air passage by ligature material and the external aspect of the neck'.
Meanwhile, the counsel for the accused also argues why no fingerprints were collected from the crime scene especially from the electric wire, or the plug point for cross verification.
The Counsel for the accused as per the Court order had said, 'it is pertinent to say that the Prosecution not even produced a single eye witness to prove that the alleged offence was committed by the accused involved in the case'.
However, the prosecution did show an eyewitness, a neighbour of the victim who in record had stated that she saw the accused rush hurricane out of the victim's house.
The eyewitness had stated that she was having to lose motion and had gone to the ground nearby the victim's house to defecate and that when she saw the accused.
The Court did not accept the victim's claim stating why she would defecate in the open when there is a toilet in her residence. Shockingly the prosecution had not provided the reason behind it in the Court.
The eye-witness had later provided an explanation that the toilet was built in her house under the Prime Minister Modi scheme but her family preferred to defecate in the open as it was not properly constructed.
Court later acquitted the accused which led to Statewide outrage. On 9th October, Saloons across the State were shut as the victim was Navidar community (who cut hair) demanding justice.
On 16th April 2019, the victim was found dead at her home by her mother who had returned from work.
The child's dress was removed and she had injuries on various parts of her body with blood on the floor.
The electric wire was shoved in her mouth and nose.
