It said that 'why should a wife be less empowered than a sex worker' and noted that 'if a sex worker can say no' why can't a wife. It was hearing a petition wanting criminalisation of marital rape and said that 'excluding marital rape from the ambit of rape seems problematic.' Meanwhile, the Centre told the Delhi HC that it is exploring constructive ways to criminalise marital rape and had sought suggestions from State Governments, the Chief Justice and others.
